The Chesapeake and New England regions Essay By the 1700s the English came to the New World and settled in The Chesapeake and New England regions. The lives of the people settled in these regions were centered on two dissimilar lifestyles. Distinctive differences between these regions were in expectations, beliefs, and social cultures. The differences created a clear cut between North and South. The wide gap between the development of The Chesapeake and New England regions was mainly because of the way their lives were centered. The Chesapeakes were geared around monetary profits and striking it rich, while New Englands focal point was about family and religious freedom. The Chesapeake region was settled in part to get rich quick, like what Captain John Smith said there was no talkbut dig gold, wash gold, refine gold, load gold (Doc F). Life expectancy was low because people only cared about gold. They barely took time to eat and take care of themselves. Diseases took its toll on the people of this region; few people lived to the age of 50. Because of that many people grew up never knowing their grandparents, which led to no family values being taught. Women were scarce; men outnumbered women six to one. In the Ships List of Emigrants Bound for Virginia there was about fifty single men and sixteen single women aboard. (Doc C) Governor Berkeley and His Council reported on their inability to defend Virginia against a Dutch attack because one third of the freemen available for defense are single freemen whose labor will hardly maintain them. (Doc G) Many woman wound up pregnant before marriage and many ended up widows having to raise a family as a singl e mother. The Chesapeake regions soil and weather was perfect for tobacco cultivation. They profited quickly with tobacco, but tobacco ruined the soil so they constantly had to expand for more land to grow more tobacco. With the scarcity of people, the need for laborers was high. In the beginning indentured servants were given passage and sometimes a small plot of land to come to the colony to work. Once they were freemen most of them never received their land, which led to the Bacons Rebellion. To justify the rebellion, in Bacons Manifesto, he stated that the government and land owners were at fault for the rebellion for withholding the land and money they fully deserved and were promised. (Doc H) Then black slaves became the  labor source of the Chesapeakes. They were less rebellious and easily controlled according to the landowners. Racial discrimination developed with the thinking that the blacks were made to serve. The social gap began to appear and widen causing much controversy in the area. On the other hand there was the New England region, where the people had a completely different view on life. The priority of this region was a family focus. In New England it was much cleaner, nicer, and cooler so there was little disease and death. This increased the life expectancy by ten to twenty years, which helped create a better stable family life. People grew up knowing their grandparents, and widowhood was less common. In the Ships List of Emigrants Bound for New England nearly all of the emigrants were families of more then four. (Doc B) New Englanders tended to stay together as a family. Women married in their twenties and gave birth every two or so years. New England men had much power over the women because widowhood was less likely many women didnt have the same rights as they did in the south. Towns were centered on the community so they intended that the towns be composed of at least forty familiesrich and poor, and that everyone should have a share of meadow and a house lot. (Doc D) In every town there was a meetinghouse surrounded by house and a village green. A meetinghouse was used for community gatherings and a place of worship. Puritanism was very strong in the New England region. The town recommended that all tradesmen consider the religious end of their callings and how they can and will be serving God. (Doc E) Education was of high importance; towns of fifty families had to provide primary education and towns of one hundred had to proved secondary education. They established their first college, Harvard College, only eight years after settlement unlike Virginias college, William and Mary, which took eighty years. New Englanders became great traders because they had a lack of soil and planting area. Which made it less ethnically mixed because there was no need for black slave labor. Fishing and ship building were other main occupations of New England. Weather was extreme and rivers were fast-moving which contributed to their isolation from England. Because of this New England colonist were very stern, stubborn, self-reliant, resourceful, and energetic. The English settling in America led to the development of The Chesapeake and New England regions. The final result from these settlers was two distinct societies. Although they came to the New World on the same voyage, they were more different than you could imagine. The Chesapeake region achieved their pursuit of wealth and maintained an upper class society. They kept slaves on their plantations, and built bigger and better homes for themselves. The New England region prospered within their families, freedom to practice their religion, and kept and enjoyed a simple life. They maintained the value of a proper education, and continued to teach their children scripture. As far as dreams go, both regions succeeded in fulfilling them. Herbert George Wells One of the most prolific writers of his time, H.G. ( Herbert George) Wells was able to do it all. He was universal, and could write from many different sides. He was one of the most versitile writers, as he could write like a novelist, as in the The History of Mr. Polly. He could also write short stories, like The Star, or The Door In The Wall. He was also considered to be a visionary and a dreamer, as shown throughout A Modern Utopia, and Men Like Gods. What Wells was most famous for was his ability to be a scientific romancer. His novels, The Time Machine, The War of The Worlds, and The Invisible Man, were what he became most widely known for. All his writings, in the different genere's they were written from, truly prove he was one of the most versitile writers that ever lived. The date was September 21, 1866, and the place was 47 (now renumbered 172) High Street, Bromley, Kent, a suburb of London.. His father, Joseph Wells, and his mother, Sarah, had been married in 1853 and they had four children. An elder sister, Fanny, had died at the age of 9 two years before H.G. was born. After he was born, his family was worried that he may also die like his sister Fanny, being that he was a sort of "weakling" and struggled to not get sick most of the time. His father was a shopkeeper and a professional cricketer, and his mother served from time to time as a housekeeper at the nearby estate of Uppark. His father's business failed and the family never made it to middle-class status, so Wells was apprenticed like his brothers to a draper, spending the years between 1880 and 1883 inWindsor and Southsea as a drapeist. In 1883 Wells became a teacher/pupil at Midhurst Grammar Scool. He obtained a scholarship to the Normal School of Science in London and studied there biology under T.H. Huxley. However, his interest faltered and in 1887 he left without a degree. He taught in private schools for four years, not taking his B.S. degree until 1890. Next year he settled in London, married his cousin Isabel and continued his career as a teacher in a correspondence college. From 1893 Wells became a full-time writer. After some years Wells left Isabel for one of his brightest students, Amy Catherine, whom he married in 1895.

Australian Consumer Law

There was a major change for Australian Consumer Law. Within this paper, the differences on the old and the new system will be discussed further. Australian Consumer Law is a single national law, which is, applies in all jurisdictions, to all business and to all industry sectors. The ACL also represents a new approach to considering consumer policy issues, with the Australian Government and the States and Territories working closely together to consider develop and implement changes. This essay will explain about the differentiation between the old system and the new system. There are several benefits for the consumer such as, this ACL will replace 20 existing state with one law, this new law is also easier to understand and clearer. On the 1st January 2011 was the beginning of a new consumer policy in Australia. That policy is called ACL (Australian Consumer Law), ACL is a single national law covering all each state and territory. This ACL will replace the Competition and Consumer Act 2010 and will renaming the Trade Practices Act 1974. This law will also apply similar to Commonwealth law. Every state and Territory will also make the ACL as their policy so that it will be equal for all Australia. All Australian courts and tribunals also from the states and territories enforce this law. This law has created a new different system as mentioned above, this law is one for all. There will be several major changes applied to customer or to seller. For example; * Product safety, a new national product safety legislative regime is set out. Also includes extensive new notification requirements for all suppliers. * Misleading or deceptive conduct, ACL prohibit misleading or deceptive conduct in trade or commerce. The ACL will provide the same broad protection as section 52 of the TPA. Unfair Contracts, on the old law this took effect at a commonwealth level in Victoria and NSW and now, this law took effect as law of other states and territories on 1 January 2011. * Unsolicited sales; a new national governing unsolicited consumer agreements (door to door sales, telemarketing and other direct sales) are introduced. * Lay-by agreement is also introduced in this ACL. * Product safety, a ne w national product safety legislative regime is set out. Also includes extensive new notification requirements for all suppliers. There are also specific protections for the new ACL against unfair business practices. Not like the general protections mentioned above this specific activities that can be particularly caused negative impact, such as; * Failing to supply gifts and prizes or not supplying them as offered (mislead). * Pyramid selling schemes; such as network marketing. This new ACL also cover consumer guarantees. They create a single set of statutory consumer guarantees replace the old system of conditions and warranties in the Trade Practices Act. The guarantees modernise and clarify the operations of the law on consumer rights in relation to goods and services and align Australia’s law with the New Zealand Consumer Guarantees act 1993. Lay-by agreements, on this ACL there is a rules that cover the basic elements of lay-by agreement transactions in a non-prescriptive way. There are some key themes in the Consumer Law changes – enhancing consumer protection, reducing regulatory complexity and having a consistent national approach to facilitate a seamless national economy. The key components of the framework involve a new national consumer law, to be called the Australian Consumer Law, based on the existing consumer protection provisions of the Trade Practices Act (TPA). In addition, there will be some new consumer laws including: Provisions which regulate unfair terms in consumer contracts; new penalties, enforcement powers and redress options for consumers (ultimately, what every supplier doesn't want to hear); and a new national product safety regulatory system. There are strong reasons to have a national approach to consumer protection in Australia. The obvious reason is to ensure a consistent approach for both suppliers and consumers. Many organisations that supply consumer products and services, supply to consumers nationally and this is an increasing trend. It can become a logistical nightmare to manage different regimes in different states. In addition, there is no rational explanation for why consumers are offered different levels of protection just because they live in a certain state or territory. For some organisations, however, introducing a national approach with new consumer laws will mean change and substantial review of existing processes – this of course, means time and money. For example, a national approach to unfair contract terms will mean that organisations supplying to consumers will need to ensure that their agreements do not contain â€Å"unfair contract terms†. According to the Council of Australian Governments (COAG), unfair contract terms are those, which cause significant imbalance in parties' rights and obligations arising under a contract and are not reasonably necessary to protect the legitimate business interests of the supplier. Such terms will be prohibited in agreements (ie. greements that are not negotiated) with remedies available where a claimant can show detriment to the consumer, or a substantial likelihood of detriment (not limited to financial detriment). In getting up to speed on this change, it will be important for organisations to assess the meaning of an â€Å"unfair contract term† – the Consultation Paper provides some examples, but in practice it is likely that there will be uncertainty about what is an d isn't an unfair contract term. Based on all of those changes in ACL, it can be seen that the government trying to give an equal opportunity for every customer in Australia. As mentioned above, if we are buying iPad in Northern Territory, we will get insurance or a certain bonus but not when we are buying it in Victoria. The population of some certain states causes this issue, thus a store on the other state must have another promotion to cover their customer. On the other side for a business opportunity, this will be a little bit harder for a businessman to grow their business. They are so many rules for them to protect customer to be harmed.
